The terms on which JBR Photography takes bookings and sells prints and downloads, and the legal notice for this website. The document that applies to you is the one shown before you pay; the others are here so you can read them all in one place.

These terms apply when you book a photography session with us as a private customer. Please read them before you book: when you pay your booking fee you are agreeing to them. If you are booking for a business, club or organisation, our business terms apply instead.
Your session is confirmed when you have chosen a date and time, paid the booking fee, and received a confirmation email from us. Until all three have happened the date is not held.
The booking fee is the amount shown against your package before you pay. The balance is due 7 days before your session, and we will email you a payment link before it falls due. If you book with fewer than 7 days to go, the whole amount, including any travel charge, is taken when you book, and there is no separate booking fee or balance. If the balance is not paid by the day of the session, we may treat the booking as cancelled by you (see section 3).
Sessions within 20 miles of our base in Sutton Coldfield ([to confirm — base postcode]) carry no travel charge. Beyond that we charge 20p a mile. Where we come to you from another session that day, the distance is measured from that session's postcode rather than from our base, and the first 20 miles are free from there in the same way. The distance is the road distance between the two postcodes where we can measure it, and otherwise the straight-line distance between them (road miles are longer; we do not charge for the difference). The travel charge is shown before you book, is the amount you pay, and is added to your balance payment rather than taken with the booking fee.
Because you booked at a distance (online or by phone), you have 14 days from the day after you book to cancel for any reason, with no charge. This is your right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To use it, email photos@jbrphotography.uk. No form is needed, though you may use the cancellation form at the end of these terms. We will refund everything you have paid within 14 days of your email.
If your session is less than 14 days after you book, we cannot photograph it inside your cancellation period unless you ask us to. So when you book at short notice you will be asked to tick a box confirming that you want us to go ahead before the 14 days are up, and that once the session has been carried out you will lose the right to cancel it. If you cancel after asking us to go ahead, you pay for the part of the service we have supplied by the time you tell us, in proportion to the full price. Once the session has been photographed, most of the service has been supplied, so most of the price is due; once your gallery has been delivered, all of it has.
Once your 14 days have passed, the booking fee holds your date and turns other work away, so it is not refunded if you cancel, with one exception: if we are able to fill your date with another booking, we refund your booking fee in full.
If you need to move a second time, we will do our best, and we may ask for a new booking fee.
If we cancel for any reason other than those in this section, you get everything you have paid back in full, and because we would keep your booking fee if the positions were reversed, we also pay you a sum equal to your booking fee if we cancel with fewer than 7 days' notice and without a good reason. We will help you find another photographer if you would like us to.
If the weather makes an outdoor session unsafe or unworkable, we will agree a new date with you at no cost. That decision is made together, not imposed. If illness or an emergency prevents us attending, we will tell you as soon as we can and either agree a new date or refund you in full. We are a one-person business: we will not send you a substitute you have never met.
Please arrive on time. A session runs for the length you booked, and time lost at the start cannot always be added at the end.
We will do our best to photograph what you have asked for, but photography is not a mechanical process: light, weather, animals, children and sport all do what they do. We cannot guarantee any particular photograph, only that we will work properly at it.
If anyone at your session does not want to be photographed, tell us. Nobody is photographed who does not want to be.
You are responsible for the behaviour and safety of people at your session, for any permissions needed to photograph at a location you have chosen (a venue, a park with rules, a school), and for any entry fees.
We will email you a private link to your online gallery, usually within 10 working days (15 working days for events, parties and sport, which produce many more frames). If it is going to take longer, we will tell you why.
Your gallery is free to view. The link we send you works for 30 days; your photographs are kept for 12 months from the date of your session, and within that time you can ask for a fresh link at any point by emailing photos@jbrphotography.uk. What you can do from the gallery depends on your package and is shown on the gallery itself: view, download, and order prints.
The number of photographs delivered varies with the session and what happened in it. We deliver the ones worth keeping, not every frame taken, and we do not supply unedited or rejected files.
Where children are photographed, their photographs are deleted from our systems 12 months after the session, as our consent forms promise, and no new link can be issued after that. Download what you want to keep before then.
Booking a session is not the same as agreeing to how photographs are used, and we keep the two separate on purpose.
If we would like to use your photographs on our website, portfolio or social media, or to sell prints of them to other people, we will ask you separately with a consent form, and you choose what you are happy with. You can say no to all of it and still have your session and your photographs. You can change your mind later, and every consent form carries a link to do exactly that.
Photographs of children are never sold or licensed to anyone else. That is not a box a parent can tick; it is simply something we do not do. A parent can order prints and downloads of their own child from their own gallery; nobody else can.
Copyright in the photographs stays with us (sections 9 and 11 of the Copyright, Designs and Patents Act 1988), the normal position in UK law for a professional photographer. Because you commissioned the photographs for private purposes, section 85 of the same Act gives you the right to stop us publishing or exhibiting them, and we only ever use them publicly with the consent you give on the separate consent form (section 7). Copyright and that consent are two different things: keeping the first does not give us the second.
You get a licence to use your photographs for your own personal use: printing them, framing them, sharing them with family and friends, and posting them on your own personal social media. You may not sell them, licence them to anyone else, enter them into competitions, or use them to advertise a business without asking us first.
Please do not crop the photographs heavily, edit them heavily, or apply filters before sharing them publicly. A credit ("JBR Photography") is always appreciated and never required.
If you booked a session for business use (headshots, a club, a brand), our business terms apply and the licence is different.
Prints ordered through your gallery are made to order by our print supplier and posted directly to you. Our print and download terms of sale (document C) apply to those orders and are shown before you pay.
Email photos@jbrphotography.uk and we will reply within 3 working days. We would always rather fix a problem than argue about one.
We carry public liability insurance. If a session is not delivered at all through our fault, our liability is limited to refunding everything you have paid for it plus any reasonable costs you told us about in advance and have wasted as a result (for example, a venue you hired for the session), up to a further sum equal to the price of the session. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded, and nothing here affects your statutory rights as a consumer, including your right under the Consumer Rights Act 2015 to a service performed with reasonable care and skill.
How we handle your personal information is set out in our privacy notice at jbrphotography.uk/privacy. In short: we keep what we need to run your booking and no more, we do not sell it, and you can ask to see it or have it deleted at any time.
We will not send you marketing email unless you have separately agreed to it, and you can stop it with one click at any time.
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If any part of them turns out to be unenforceable, the rest still applies. We may update these terms; the version you agreed to when you booked is the one that applies to your booking, and we keep a copy of it.
Complete and return this form only if you wish to cancel within your 14-day period.

These terms apply when a business, sports club, school, venue, charity or other organisation ("you") books JBR Photography. They do not apply to private customers, who have their own terms and a 14-day cancellation right that these terms do not carry. If you are an individual booking for purposes outside any trade, business, craft or profession (a parent organising a team's photographs, say), you are a consumer in law and the session booking terms (document A) apply to you, whichever option you chose when booking.
Our quote sets out the date, hours, location, what is delivered, the price and any travel charge. A booking is confirmed when you accept the quote in writing (an email is fine) and, where the quote asks for one, pay the booking fee. Quotes are valid for 30 days.
Unless the quote says otherwise: the booking fee is due on acceptance and the balance is due 14 days from the date of our invoice, by bank transfer or card. We may charge statutory interest and compensation on late payment under the Late Payment of Commercial Debts (Interest) Act 1998 or, where that Act does not apply to you, interest at 8% a year above the Bank of England base rate from the due date until paid.
You are responsible for access to the venue, for permission to photograph there, for briefing participants that photography is taking place, and for any safeguarding requirements your organisation applies (for example, a named contact for us on the day). We follow your safeguarding policy where you have one and ours where you do not.
Photographing people needs a lawful basis under UK data protection law, and the arrangement depends on the shoot. We will agree with you before the day which of these applies, and put it in writing:
No photograph of a child is ever sold or licensed, whatever the arrangement. Parents may order prints of their own child from a gallery we issue to them.
We keep the copyright. On payment in full you receive a licence to use the delivered photographs for your organisation's own purposes (your website, social media, programmes, newsletters, internal use and press releases), in perpetuity, worldwide. The licence does not include selling the photographs, licensing them to a third party, or using a person's photograph in a way that would need their separate consent (for example, in paid advertising). Those uses can be agreed for an additional fee.
Individual players, members or staff who appear may use photographs of themselves for personal use. Please credit "JBR Photography" where practical.
Galleries are delivered by private link, normally within 15 working days. Where the quote includes galleries for individual families, each family receives their own link. Links work for 30 days and can be reissued on request; the photographs are kept for 12 months from the session.
Our total liability to you under a booking is limited to the price of that booking. We are not liable for indirect or consequential loss. Nothing limits our liability for death or personal injury caused by negligence, or for fraud. We carry public liability insurance and can provide the certificate on request.
These terms and our quote are the whole agreement. Neither of us may assign it without the other's consent. These terms are governed by the law of England and Wales.

These terms apply when you buy a print, or a download of an album, from jbrphotography.uk or from a gallery link we have sent you. By paying you agree to them.
Prices are shown in pounds sterling and include any VAT. Delivery is shown as its own line before you pay. Payment is by card at checkout, through Stripe. Your order is placed when payment succeeds, and we email you a confirmation.
Prints are made to order from the photograph you chose, at the size and on the product you chose. What each product is (paper, finish, whether it comes with a hanger or an envelope) is described on the product before you buy; if a fact is not stated, please ask before ordering rather than assume it.
A download is the full-resolution JPEG files of the album named on the link, without a watermark, which open on any phone, tablet or computer, for your personal use under the licence in section 6.
Prints ordered from your own gallery are made from photographs of you and your family, to your choice of crop and size. They are clearly personalised goods, so the 14-day right to cancel that applies to most online purchases does not apply to them (Consumer Contracts Regulations 2013, regulation 28(1)(b)). Once an order is paid it goes to print automatically, usually within minutes, and cannot be cancelled. This does not affect your rights if something is wrong with what arrives (section 5).
Prints ordered from the public shop are of our own work at standard sizes, so you have the usual right to change your mind: you may cancel within 14 days from the day after the print is delivered by emailing photos@jbrphotography.uk or using the form at the end of these terms. Return the print to the address we give you, at your own cost, within 14 days of telling us, and we refund the price and the standard delivery charge within 14 days of receiving it back (we may deduct for handling that goes beyond what is needed to inspect the print).
A download is digital content. Before you pay you will be asked to confirm that you want the files supplied straight away and that you understand you lose the right to cancel once the download begins. If we did not ask you, you keep the right to cancel for 14 days.
Prints are posted by our supplier to the address you give at checkout. We email you when your order is dispatched, with tracking where the service provides it. An order can arrive as more than one parcel (a canvas and a card travel separately); the dispatch email says how many to expect. Check the delivery address carefully: we cannot redirect a parcel once it has left.
Tell us within 14 days of delivery at photos@jbrphotography.uk with a photograph of the problem, and we will replace the print at no cost or refund you (your choice). Your legal rights under the Consumer Rights Act 2015 (goods must be of satisfactory quality, as described and fit for purpose) are not affected by that 14-day request and last longer than it.
A print made from the photograph and crop you chose, at the size you chose, is not faulty because you would have preferred a different crop; the crop is shown before you pay.
The photographs remain the copyright of JBR Photography Limited. A print or download is licensed to you for personal, non-commercial use: displaying, framing, sharing with family and friends, and posting on your own personal social media. You may not sell, reproduce for sale, licence to others, or use the photographs commercially. Where the photograph is of a child, that child's photograph is never sold to anyone other than a person responsible for them.
If we refuse or cannot fulfil a paid order (for example, because permission to use a photograph has been withdrawn after you paid), we refund you in full to the card you paid with, normally within 5 working days, and tell you why.
Email photos@jbrphotography.uk; we reply within 3 working days. These terms are governed by the law of England and Wales. Nothing in them affects your statutory rights. The model cancellation form at the end of the session booking terms (document A) may be used for a print order from the public shop.

Copyright. All photographs, text and design on this site are © JBR Photography Limited unless stated. You may not copy, download, scrape, reproduce or use any photograph from this site without our written permission, except where a gallery link we have sent you expressly allows downloading. Screenshots of a watermarked gallery are not permitted.
Galleries and links. Gallery links are private and are issued to named people. Do not forward a link to anyone the photographs were not shared with. We may revoke a link at any time.
Bookings and purchases are subject to the terms above (A, B or C as applicable), which are shown before you pay.
Accuracy. We take care with what is on this site but do not promise it is free of errors or always available. Nothing on this site is an offer capable of acceptance; a booking or order is formed as the relevant terms describe.
Privacy and cookies are covered by our privacy notice at /privacy. The site sets only the cookies that notice lists, all of them strictly necessary, and carries no advertising or analytics trackers.
Law. These terms are governed by the law of England and Wales.
